So recently I began to inhabit this little virtual world called Legend City Online. It’s a nice start up virtual community, lower prices for land tier than Second Life and it appears the creators actually care about the users. Which is nice. So, while bopping around this virtual word I notice Textures R Us is setting up shop. Those of you familiar with Second Life may remember TRU from being one of the largest texture sellers in Second Life. Or, you may remember them from these stellar incidents:

and other fun most recently the owner of TRU one Lillybeth Filth has begun to turn on her own as seen here
But I’m getting off topic here so let’s go back to what I was originally talking about. I own a lot of TRU textures. In fact I would estimate I own about 20,000L$+ in TRU Textures. So when I discovered a program called Second Inventory I thought to myself “great, now I can build in LCO using the textures I have purchased with full permissions” And then I check their new EULA which states
You cannot share, give, sell or otherwise distribute for free, linden dollars ($L), or any real life currency Textures R Us textures. ***This includes other grids or “open source” platforms . We will be launching an investigation and working with the grid owners to clean up any textures that have been uploaded without our written permission***
You can sell objects created which require our textures to be part of the creation such as scripted furniture. But the textures must never be set to full permissions. Ensure you untick the “Resell/Give ” permission before adding TRU textures to your scripted devices. Your customers must NOT be able to resell/distribute for profit or free our artwork just as you cannot.
You cannot choose to freely distribute your texture files to anyone regardless of whether the perms are No Transfer or not. Furthermore you may NEVER transfer our textures to anyone marked as full perms.
Anyone reported as reselling textures from Textures R Us in any form will be dealt with by Legend City Online DMCA department. The textures will be removed from your inventory and if they exist inworld they’ll be removed there too. If the copyright break is large or has taken place over a long period of time we will consider seeking legal and financial damages.
You cannot save to hard drive to then re-upload in your own name for the purposes of distribution free or otherwise. Any cases of this will be dealt with in the same manner as detailed above.
You cannot save to your hard drive to distribute or otherwise share on outside Websites, copy to CD/DVD or any other form of distribution free or otherwise. Any reports of this will be pursued pursuant to the Digital Millennium Copyright Act (DMCA), the EU Copyright Directive or EUCD and other applicable laws and treaties.

Personally, I was flabbergasted. I could not believe the sheer greed I was hearing roll out of text. I’m going to have to buy all those textures again? When I bought them full perms in world? I don’t think so. So, being more curious I check her profile picks in SL as that is usually where she posts the most information. And from there I find this.
It is clearly outlined on our website and in our End User Agreement Licence that the use or transfer of TRU textures to other virtual worlds is strictly prohibited. Artists create for Second Life use ONLY. If and when we establish our business in other virtual worlds all artists and contracted websites artwork should not be used in other virtual worlds/websites. We understand the need for quality textures in your building projects in worlds other than SL and are working towards making that possible. Until then please understand it is not our fault Linden Labs have increased the prices on Open Sims and we will not change our user license to suit customers choice in virtual worlds. The founders of various other grids have assured us ALL ilegal textures currently being used once identified will be wiped from the entire grid. Please respect our right to protect our business and copyright. Thank you.
Great…..so you’re selling the same textures in a different virtual world, however the artists made the textures for SL only. Am I the only person here who doesn’t buy that load of shit? Now, I consider myself a calm and rational human (if you disagree I will set you on fire) however when I see shit like this I’m inclined to use my middle finger excessively and let loose a string of profanities. That will not happen today. However he is what will happen.

B: Will attempt to look for the E-Lawyer you used to write that silly EULA so that I may point and laugh at them

The problem is that the copyright limitations for “full perms” has never really been clearly defined. You may very well be on the receiving end of a DMCA by the Filthy one if you transfer your TRU textures to the new grid.
HOWEVER, I am not sure that she can really have a case if you purchased the textures before the new EULA was published; you did not, after all, agree to the new terms. But she can still make life more difficult than necessary for you.
Besides which, I recommend making your own textures if possible. That way you aren’t risking violating the copyright of the ACTUAL artists – which are frequently violated by Filth’s reselling in SL.
I thought about that. However my RL is kind of busy so I find using pre-made textures a bit more easy. Also I usually heavily modify them before using them (Which I found out is also against her EULA)

Considering that many of the textures that TRU sells come straight from the web, what sort of copyright might be held?
I have nothing against TRU cause I own a buttload of their textures and they are pretty useful when I have already scoured the web for free textures and istock has come up short. I haven’t been there in ages though.
My reason for commenting is to say that there is a Photoshop plugin you can buy called Filter Forge. Many of the TRU textures were made with this (or they just took the textures off the filter forge website, idk. You can take the textures off the web site too if you see something you dig.)
It’s the best thing I’ve ever bought. Seriously worth it if you build in SL. You can edit the filters or if you don’t get the uber version you can mod the community made filter’s variables.
